Terms of sale

1 – Seller

These terms govern online sales between Marchi Theo, sole proprietorship, 7 Rue Lucien Bonmarchand, 92370 Chaville, France, SIRET 108 089 814 00017, contact: contact@get-lumino.com (the “Seller”) and any person placing an order (the “Customer”). Sales are intended for consumers.

2 – Acceptance

Placing an order means you accept these terms in full, by ticking the box provided at checkout. The terms in force on the date of the order apply.

3 – Products

Products are described with their main features (LED facial mask, PP material, 5V/1A, 3.7W, 180 LED lamp beads, 400 mAh battery, 2-hour charging time, 100-minute use time). Photos and videos are illustrative. The product is a cosmetic wellness device, not a medical device, and is not intended to diagnose, treat, cure or prevent any disease. Results vary and are not guaranteed. A free digital e-guide (PDF, 15 pages) comes with every order and can be downloaded from the website or the confirmation email; it is provided free of charge for information only and does not replace the advice of a health professional. Read the manual and follow safety precautions (eyes closed during use; seek medical advice first in case of pregnancy, photosensitivity, epilepsy, photosensitising medication or a skin or eye condition).

4 – Prices

Prices are in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. Shipping is free to supported destinations. Promotions (2nd mask at −50%, Trio pack, discount codes) apply under the displayed conditions and are not cumulative unless stated. The price is the one displayed when you confirm the order.

5 – Ordering

Select the product, add it to your cart, accept the terms, enter your delivery address and pay. A confirmation email is sent after payment. The Seller may refuse or cancel an order for a legitimate reason (out of stock, incorrect address, suspected fraud); the Customer is then fully refunded.

6 – Payment

Payment is due immediately by card or another method offered (Apple Pay, Google Pay…) through the secure platform Stripe. The Seller does not have access to card data. If payment fails, the order is not validated.

7 – Delivery

Orders are shipped within 1 to 3 business days after payment confirmation; estimated delivery is 5–12 business days, for information. At the latest, delivery takes place within 30 days of the contract (article L216-1 of the French Consumer Code). Risk of loss or damage passes to the Customer on physical delivery. If a parcel is damaged, please make reservations with the carrier and write to us within 48 hours with photos, without prejudice to your legal rights. See shipping.

8 – Right of withdrawal

8.1 You have 14 days from receipt of the product to withdraw from the contract without giving a reason.

8.2 Notify us by email at contact@get-lumino.com or with the model form on the returns and withdrawal page before the deadline, then return the product without undue delay and within 14 days of notifying us, complete (mask, strap, cable, manual) and properly protected.

8.3 The direct cost of returning the product is borne by the Customer.

8.4 We refund all payments, including standard delivery costs, within 14 days of being informed of your decision; we may wait until the product is received or proof of shipment is provided. The refund uses the original payment method.

8.5 You are only liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

8.6 Hygiene exception. Under article L221-28 (5°) of the French Consumer Code, the withdrawal right does not apply to goods unsealed by the Customer after delivery that cannot be returned for hygiene or health protection reasons. Because the mask is in direct contact with facial skin, a mask whose original seal has been removed and that has been used cannot be returned. A product merely unpacked to check it, unused and complete, remains eligible for return.

9 – Legal guarantees

The Seller is liable for lack of conformity (legal guarantee of conformity, articles L217-3 et seq. of the Consumer Code, 2 years from delivery, with a 24-month presumption) and for hidden defects (articles 1641 et seq. of the Civil Code). The Customer may choose between repair and replacement, otherwise a price reduction or termination of the contract. To exercise these rights, write to contact@get-lumino.com. They do not cover normal wear, misuse, drops, water damage or unauthorised repairs. Mandatory consumer rights are not affected.

10 – Liability

The Seller is liable within the limits allowed by law and is not liable for use contrary to the manual or safety precautions, nor for indirect damage. Nothing in these terms excludes liability for fraud, gross negligence, personal injury or anything that cannot be excluded by law, or your mandatory consumer rights. The Seller is not liable for force majeure.

Website content is protected. Reproduction without permission is prohibited.

13 – Customer service and mediation

Complaints: contact@get-lumino.com or the contact page, reply within 2 business days. For unresolved disputes you may use the consumer mediator free of charge: [TO COMPLETE: name, postal address and website of the consumer mediator you subscribe to].

14 – Governing law

These terms are governed by French law. A consumer may bring proceedings before the courts of their place of residence. Mandatory consumer protection rules of the country of residence of EU consumers remain applicable.

15 – Changes

The Seller may amend these terms at any time; the terms in force on the order date apply.
